In Minnesota, courts have the ability to award spousal support during marriage, while divorce or separation is pending, or as part of a divorce decree.  The purpose of spousal support is to ensure an adequate income stream for persons who are economically dependant as a result of the marital relationship.

In determining the amount of the award, need and ability to pay are generally the two most important factors.  In Minnesota, while courts will not look to fault or infidelity in determining alimony, they may consider:

  • Standard of living
  • Length of marriage
  • Age and physical and emotional condition of parties
  • Employability of spouse seeking maintenance
  • Amount of time needed to gain skills or education to find appropriate employment
  • Financial resources of each party
  • Contribution of each party to the marriage
